Dispute Resolution Practice
Mediation is a facilitated negotiation. It differs from arbitration in that the mediator cannot force a party do something. Parties reach a resolution when they decide that they will. Karen helps you to evaluate risk and options so that you are able to make decisions and implement strategies to resolve a dispute.
- Communicate with Karen. The form is not important. It can be by letter, email or phone call. It may be that you have a motion for summary judgment or other such document that succinctly communicates best. The important part is the information communicated.
- When you schedule and provide case information, Karen will be able to see much of the information on the Court’s web portal. You do not need to provide all of the pleadings.
- It is particularly helpful when you tell the mediator whether there have been any negotiations or discussions prior to mediation.
- It is helpful to know when there are any unique legal issues, and attaching case copies helps.
- Generally, you should let Karen know if you need help with anything. Are there any specific or general concerns you have? Is there something Karen should know about personalities, relationships or past dealings?
- Mediation doesn’t follow a pre-set timeline. If there are any time constraints, for example, if a party has a flight out that day that will create a cut-off time, you must let Karen know well in advance.
- Karen is generally a facilitative mediator. She wants to hear your ideas for resolution, and she wants any resolution reached to hold fast over time. When appropriate, she will use evaluative methods, particularly late in the process.
- Feel free to discuss with Karen what you need from her as your mediator. Discussing your case gives all concerned an opportunity to see if Karen is a good fit for your dispute. (214) 969-9048
